Chief of the Appeals Bureau

The Kings County District Attorney’s Office is seeking a senior level Attorney to join the office to serve as the Chief of the Appeals Bureau. Responsibilities of this position include:

  • Supervising and managing ADAs and support staff in the Appeals Bureau
  • Editing briefs, motion responses, and responses to federal habeas petitions

Position Overview

 

The Kings County District Attorney’s Office seeks a dedicated and experienced attorney to serve as the Chief of the Conviction Review Unit (CRU). This role offers the opportunity to lead the nation’s largest and most effective unit dedicated to investigating credible claims of wrongful convictions, ensuring fairness, justice, and public safety.

 

Brooklyn’s CRU has exonerated over 500 individuals through rigorous reinvestigations that examine evidence with fresh eyes. The unit uses cutting-edge forensic and social science methods, consults with experts, and re-interviews witnesses to uncover the truth. By addressing potential miscarriages of justice, the CRU strengthens public trust in the legal system and ensures that the right person is held accountable for violent crimes.

 

As Chief of the CRU, you will oversee complex investigations, collaboratively lead a skilled team of attorneys and investigators, and recommend appropriate actions to the District Attorney. Beyond case reviews, the CRU shares its expertise nationwide, helping other offices establish or enhance conviction review programs, and trains Brooklyn prosecutors on common causes of wrongful convictions.

Key Responsibilities

 

  • Provide strategic leadership and direction for all investigations conducted by CRU.
  • Supervise the collection and analysis of case materials, including trial records, witness statements, and new evidence.
  • Prepare comprehensive reports and recommendations for the District Attorney based on completed investigations.
  • Facilitate collaborative internal discussions to determine appropriate next steps in each case.
  • Represent CRU in public forums, professional associations, and community engagements to advocate for transparency and reform.

Essential Qualifications

 

  • Licensed attorney eligible to practice in New York.
  • Minimum of ten years of post-J.D. experience litigating criminal cases as a prosecutor or defense attorney.

Deputy Chief of the Freedom of Information Law (FOIL) Unit.

The Kings County District Attorney’s Office is seeking a qualified attorney to work as an assistant district attorney in the role of Deputy Chief of the Freedom of Information Law (FOIL) Unit.  The FOIL Unit is responsible for all FOIL requests to the Office for records, as well as requests from other agencies (primarily the NYC Law Department) for records.  The position entails overseeing a staff of paralegals, and includes training new staff, reviewing answers to difficult or confusing requests, answering administrative appeals, opposing C.P.L.R. Article 78 petitions and appearing in court on those petitions, and drafting appellate briefs and appearing for oral arguments when the C.P.L.R. Article 78 decisions are appealed to higher courts. 

 

The Deputy FOIL Unit Chief also works closely with the Civil Litigation Unit on related litigations.  Successful applicants will be expected to perform duties encompassing various aspects of New York and Federal civil practice, including: representing the Office in civil litigation matters and conducting civil motion practice; coordinating with the NYC Law Department in response to civil actions filed against the Office; preparing and defending witnesses at civil depositions; negotiating and drafting civil settlement agreements and other civil contracts entered into by the Office, and representing the Office in administrative hearings pursuant to Section 75 of New York State’s Civil Service Law (which covers terminations and disciplinary actions) as well as other employment law matters.

 

Qualified candidates must:

 

  • Be an attorney admitted to practice in the State of New York with at least 3 years of experience;
  • Have strong writing, research, and analytical skills;
  • Have appellate or other legal writing experience;
  • Have experience making legal arguments in court;

Director of Restorative Justice

The Brooklyn District Attorney’s office’s commitment to public safety includes integrating restorative practices at every level of our office’s caseload. We recognize that restorative justice can often provide better outcomes for victims in our cases, and that defendants who go through a restorative justice process are more likely to take real accountability for their actions and less likely to re-offend. KCDA received funding from NY State in 2023 to establish a restorative justice hub and since then has worked to increase the number of cases that include restorative justice as part of case resolution. The Office is seeking an individual to run the Office’s restorative justice program.

 

TASKS/RESPONSIBILITIES: 

  • Training & Technical Assistance for ADAs:
    • In partnership with RJ practitioners, develop trainings for ADAs (including for new ADAs as they join the office) to ensure they understand what restorative justice processes entail, how RJ practitioners screen cases, and how to identify and refer cases to RJ practitioners
    • Coordinate regular meetings in each of the office’s five practice zones so that ADAs can consult with RJ practitioners on specific cases and make referrals
    • Provide technical assistance to ADAs to support them in identifying cases for RJ and making referrals to appropriate RJ practitioners; ensure ADAs have necessary information from RJ practitioners to report progress to the court.
    • Develop informational RJ materials for ADAs to continue to raise awareness about the availability of various RJ resources for parties in criminal cases
  • Screening & Referring Cases to RJ:
    • Work with Executive Team to screen cases for RJ diversion
    • Reach out to ADAs on cases identified for RJ to support them in making RJ referrals
    • Track cases from referral to completion. Analyze data to understand referral patterns and how to increase number and severity of cases referred to RJ.
    • Trouble-shoot, as needed, once cases are referred for RJ to ensure parties are satisfied, processes are on track and stakeholders are appropriately informed
  • Outreach & Education to Defense Bar:
    • Reach out to Brooklyn Defender Services, Legal Aid Society and 18B panel to deepen the defense bar’s understanding of RJ, describe KCDA’s RJ approach and cultivate a partnership so cases are referred to RJ.
    • Serve as point person for defenders interested in having their cases screened for RJ.
  • Outreach & Education to Judiciary:
    • Reach out to judges to deepen the Court’s understanding of RJ, describe KCDA’s RJ approach and ensure cases are referred to RJ
  • RJ Network Development/Capacity-Building
    • Build network of community-based RJ facilitators to ensure office has access to seasoned practitioners who can facilitate cases referred at various points in criminal legal system continuum
      • Post-indictment
      • VOD with individuals in DOCC custody
      • Post-release after resentencing
  • Victim Services Capacity-Building: Partner with VSU and RJ practitioners to support the development of a network of community-based therapeutic and wellness resources to provide long-term support to victims of crimes who are referred for RJ processes
  • Reporting:
    • Draft progress reports for state and federal funders
  • Public Education/Awareness Raising:
    • Represent the KCDA at events to raise awareness about RJ work.
    • Stay up to date on resources and best practices related to RJ in criminal cases.

 

QUALIFICATIONS/EXPERIENCE

  • Law degree preferred
  • Understanding of, and experience working in, criminal legal system required
  • Training and experience in Restorative Justice and/or mediation required
  • Ability to work independently and within a team
  • Excellent communication and organizational skills

Early Case Assessment Bureau Attorney

 

The District Attorney’s Office in Brooklyn, one of the largest prosecutors’ offices in the country, has openings for new and experienced attorneys seeking flexible work schedules and the opportunity to do truly meaningful work in a vitally important section of our Office. The Kings County District Attorney’s Office is seeking qualified candidates to serve as Assistant District Attorneys in the Early Case Assessment Bureau (ECAB) which is open every day, morning and night, as well as holidays. This is a highly flexible position and qualified candidates will have the opportunity to work full-time and/or part-time schedules. ADAs in this position will work in a hybrid remote and in-person environment and will be able to work some nights, weekends, and holidays remotely.

 

Processing the vast majority of the thousands of arrests made in Brooklyn each year, ECAB provides Assistants with a rare opportunity to work with cases of all kinds across all areas of criminal law at a critical stage of the proceedings.  In a fast-paced environment that requires sound judgment and attention to detail while allowing for significant latitude and initiative, ECAB Assistants receive new arrests, interview police (and sometimes other) witnesses, and prepare a factual narrative summarizing the case.  Assistants will then work collaboratively with supervisors as the Office’s charging decision is made, drafting the charging document (complaint) for cases that will proceed and declining to prosecute or diverting those that will not.  Assistants are also responsible for preparing notices and case files necessary for arraignment.

 

ECAB assistants will also have the opportunity to arraign misdemeanor and felony cases. Arraignments and their outcomes – particularly bail settings – draw significant scrutiny, and bail was one of the District Attorney Eric Gonzalez’s first key reform initiatives. Arraignment ADAs will have a unique trust and responsibility in the Office and will be required to make fair decisions everyday while making Brooklyn safer.

Lateral Assistant District Attorney - Appeals

The Kings County District Attorney’s Office is seeking qualified attorneys to work as assistant district attorneys in the Appeals Bureau. Responsibilities of assistant district attorneys assigned to the Appeals Bureau include: writing briefs and conducting oral arguments on appeals to the Appellate Division, the Appellate Term, and the New York Court of Appeals; answering motions to vacate judgments of conviction in the Supreme Court and the Criminal Court; responding to habeas corpus petitions in federal district court; and litigating appeals to the United States Court of Appeals for the Second Circuit.

Lateral Assistant District Attorney - Deed Fraud Investigations

 

The Brooklyn District Attorney’s Office is seeking an experienced attorney to serve as an Assistant District Attorney specializing in deed fraud investigations and prosecutions within the Office’s Investigations Division. This role is dedicated to combating sophisticated real estate fraud schemes that strip Brooklyn residents of their homes, destabilize families, and erode trust in entire communities.

 

About the Work

Deed fraud is among the most devastating financial crimes prosecuted by the Office. These schemes can cost families their most valuable asset—their home—often wiping out generations of stability and wealth in a single fraudulent transaction. Victims are frequently elderly residents, immigrants, and others targeted because of language barriers, isolation, or limited access to legal resources.

Attorneys in this role investigate and prosecute complex deed theft schemes, forged transfers, fraudulent notarizations, and related financial crimes. The work is investigative, document-intensive, and highly impactful, requiring close collaboration with investigators, analysts, partner agencies, and community stakeholders.

 

Responsibilities

  • Investigate and prosecute deed fraud and related real estate and financial crimes
  • Analyze complex property records, financial documents, and transactional histories
  • Work closely with investigators and partner agencies to build long-term investigations
  • Litigate cases from investigation through indictment and disposition
  • Engage with victims and communities affected by deed fraud with sensitivity and care

Qualifications

Lateral Assistant District Attorney - Public Integrity Bureau

The Kings County District Attorney’s Office is seeking seasoned attorneys with at least 5 years of litigation as well as investigative experience to join the Office in its Investigations Division, Public Integrity Bureau (PIB).  PIB investigates corruption and crimes committed by public officials at all levels of government. This includes fraud, theft of public funds, bribery and crimes connected with procurement.  PIB also investigates corruption in the courts, including attorney embezzlement and fraud in government programs.

Applicants must be able to handle a high volume of work with strict adherence to deadlines in a fast-paced environment.  In addition, applicants for this position should have the ability to think and work independently as well as the ability to work in conjunction with other bureaus in the Office as well as with City, State and Federal law enforcement agencies. 

Attorney in the Public Integrity Bureau are responsible for long-term investigations, grand jury presentations, trials, and prosecutions in the areas of public corruption, attorney embezzlement, organized crime, and frauds, including labor fraud, real estate fraud, immigrant fraud, elder fraud, healthcare fraud, consumer fraud, cybercrime and securities fraud, and for handling a docket of court cases covering the above listed areas. 

 

Preferred Qualifications:

  • Excellent investigative skills, including significant experience drafting subpoenas, interviewing witnesses, analyzing financial and business records and creating investigative plans.
  • Excellent writing skills, preferably with experience drafting search warrants, pen registers, eavesdropping and GPS warrants.
  • Strong court room advocacy skills, including trials and grand jury presentations. 
  • Working knowledge of computer technology and participation in sophisticated cybercrime investigations.
  • Proven record of managing an investigative team in long-term, proactive investigations into complex criminal organizations involved in fraud schemes, organized crime or public corruption.

Unit Chief - Parole, Clemency, and Sealing Unit

 

The Brooklyn District Attorney’s Office is seeking an attorney to serve as the Unit Chief of the Parole, Clemency, and Sealing Unit.

The Unit, which exists within the larger Post-Conviction Bureau, reviews the cases of inmates coming up for parole and counsels the DA on what position he should take; advises the Governor’s Office on clemency petitions that are predicated on a Brooklyn conviction; handles litigation under New York’s application-based sealing statute (CPL 160.59) and retroactive youthful offender law (CPL 720.20(5)); evaluates interest-of-justice-based resentencing applications; and educates the public on all the state’s sealing laws, including the Clean Slate Act.

 

Responsibilities for the Unit Chief include:

  • Drafting memoranda on post-conviction cases for review by the Office’s Post-Conviction Review Committee and presentation to the DA
