Chief of the Appeals Bureau

The Kings County District Attorney’s Office is seeking a senior level Attorney to join the office to serve as the Chief of the Appeals Bureau. Responsibilities of this position include:

Deputy Chief of the Freedom of Information Law (FOIL) Unit.

The Kings County District Attorney’s Office is seeking a qualified attorney to work as an assistant district attorney in the role of Deputy Chief of the Freedom of Information Law (FOIL) Unit.  The FOIL Unit is responsible for all FOIL requests to the Office for records, as well as requests from other agencies (primarily the NYC Law Department) for records.  The position entails overseeing a staff of paralegals, and includes training new staff, reviewing answers to difficult or confusing requests, answering administrative appeals, opposing C.P.L.R. Article 78 petitions and appearing in court on those petitions, and drafting appellate briefs and appearing for oral arguments when the C.P.L.R. Article 78 decisions are appealed to higher courts. 

 

The Deputy FOIL Unit Chief also works closely with the Civil Litigation Unit on related litigations.  Successful applicants will be expected to perform duties encompassing various aspects of New York and Federal civil practice, including: representing the Office in civil litigation matters and conducting civil motion practice; coordinating with the NYC Law Department in response to civil actions filed against the Office; preparing and defending witnesses at civil depositions; negotiating and drafting civil settlement agreements and other civil contracts entered into by the Office, and representing the Office in administrative hearings pursuant to Section 75 of New York State’s Civil Service Law (which covers terminations and disciplinary actions) as well as other employment law matters.

 

Qualified candidates must:

 

  • Be an attorney admitted to practice in the State of New York with at least 3 years of experience;
  • Have strong writing, research, and analytical skills;
  • Have appellate or other legal writing experience;

Early Case Assessment Bureau Attorney

 

The District Attorney’s Office in Brooklyn, one of the largest prosecutors’ offices in the country, has openings for new and experienced attorneys seeking flexible work schedules and the opportunity to do truly meaningful work in a vitally important section of our Office. The Kings County District Attorney’s Office is seeking qualified candidates to serve as Assistant District Attorneys in the Early Case Assessment Bureau (ECAB) which is open every day, morning and night, as well as holidays. This is a highly flexible position and qualified candidates will have the opportunity to work full-time and/or part-time schedules. ADAs in this position will work in a hybrid remote and in-person environment and will be able to work some nights, weekends, and holidays remotely.

 

Processing the vast majority of the thousands of arrests made in Brooklyn each year, ECAB provides Assistants with a rare opportunity to work with cases of all kinds across all areas of criminal law at a critical stage of the proceedings.  In a fast-paced environment that requires sound judgment and attention to detail while allowing for significant latitude and initiative, ECAB Assistants receive new arrests, interview police (and sometimes other) witnesses, and prepare a factual narrative summarizing the case.  Assistants will then work collaboratively with supervisors as the Office’s charging decision is made, drafting the charging document (complaint) for cases that will proceed and declining to prosecute or diverting those that will not.  Assistants are also responsible for preparing notices and case files necessary for arraignment.

 

ECAB assistants will also have the opportunity to arraign misdemeanor and felony cases. Arraignments and their outcomes – particularly bail settings – draw significant scrutiny, and bail was one of the District Attorney Eric Gonzalez’s first key reform initiatives. Arraignment ADAs will have a unique trust and responsibility in the Office and will be required to make fair decisions everyday while making Brooklyn safer.

 

Job Requirements:

  • Candidates must be admitted to the New York Bar OR have recently taken the July 2023 Bar Exam OR are scheduled to take the February 2024 Bar Exam

Lateral Assistant District Attorney - Appeals

The Kings County District Attorney’s Office is seeking qualified attorneys to work as assistant district attorneys in the Appeals Bureau. Responsibilities of assistant district attorneys assigned to the Appeals Bureau include: writing briefs and conducting oral arguments on appeals to the Appellate Division, the Appellate Term, and the New York Court of Appeals; answering motions to vacate judgments of conviction in the Supreme Court and the Criminal Court; responding to habeas corpus petitions in federal district court; and litigating appeals to the United States Court of Appeals for the Second Circuit.

Lateral Assistant District Attorney - Domestic Violence Bureau

The Brooklyn District Attorney’s Office is seeking experienced attorneys to join the Office as Felony Assistant District Attorney’s in the Domestic Violence Bureau.

 

Cases arising from intimate partner violence – ranging from misdemeanor assault to homicide – present unique challenges for everyone involved, including prosecutors.  The Office’s Domestic Violence Bureau is dedicated to compassionate, effective, and collaborative responses to these serious crimes.  The Bureau has long been a national leader in innovative and holistic practices and has been at the forefront of creating and using new statutes (like the offenses of stalking and strangulation) to hold offenders accountable. 

 

The Domestic Violence Bureau is fully committed to a trauma-informed modality that centers around the needs of survivors of domestic violence, which often extend beyond a given criminal case.  Bureau prosecutors work closely with the Brooklyn Family Justice Center, a partnership of government and other agencies providing wrap-around services for victims ranging from long-term counseling to civil legal representation on immigration, family court, and housing matters.  The Center is co-located with the Bureau on the 15th floor.

 

Consistent with our trauma-informed practices, prosecutors in the Domestic Violence Bureau learn to try cases without the participation of the survivor/victim, who may not be ready to cooperate with the criminal justice process.  This practice, known as evidence-based prosecution, helps hone a prosecutor’s investigative and legal skills.  Domestic Violence prosecutors become well-versed in the most recent law regarding the hearsay rule and its exceptions, Sirois hearings, and Molineaux arguments for the admission of evidence regarding prior uncharged crimes.  Bureau prosecutors also rely heavily on digital evidence and become well-versed in using social media sites like Facebook, Twitter, Snapchat, and Instragram to prove and enhance cases, as well as material retrieved from cellular phones and historical cell site location data.

 

The Domestic Violence Bureau is fast-paced and high-volume, handling roughly ten thousand cases each year, each of which involves one or more vulnerable victims and serious public safety concerns.  Felony line assistants in the Bureau will be responsible for a range of felony cases and, in time, may begin vertical prosecutions of the most serious cases (including homicides), beginning with response to the precinct at the time of the incident.

 

Applicants should have at least five years of litigation experience and a record of jury trial verdicts. Solid knowledge of criminal procedure, search and seizure law, and evidence is required.

Lateral Assistant District Attorney - Homicide

The Kings County District Attorney’s Office is seeking experienced attorneys to join the Office in our nationally renowned Homicide Bureau.

 

The Homicide Bureau investigates and prosecutes a large majority of Brooklyn’s homicides, including many of the boroughs most complex and high-profile murder cases. The bureau, which is comprised of some of the agency’s most experienced assistant district attorneys, also serves as legal adviser to the police in homicide cases.

Lateral Assistant District Attorney - Human Trafficking Unit

 

The Kings County District Attorney's Office, located in the Metrotech area of Brooklyn, New York is seeking experienced level Attorneys to join the office in the Human Trafficking Unit.

 
The Human Trafficking Unit vigorously investigates and prosecutes those who, through force, fraud or coercion, have forced individuals into prostitution and/or labor, including as domestic servants, nannies, housekeepers, construction and restaurant workers. The unit’s staff also engages in community outreach by conducting meetings at schools and community centers to educate Brooklyn residents on the dangers of human trafficking and on how to look for warning signs that a person might be a trafficking victim.
 

Under the direction of the Unit Chief, the ideal candidates are expected to perform the following duties:

– Evaluate and investigate individuals accused of committing Human Trafficking offenses. 

– Present cases to the Grand Jury for indictment and then prosecute those cases in Brooklyn’s Supreme Court through disposition.

Lateral Assistant District Attorney - Investigations Division

 

The Kings County District Attorney’s Office is seeking seasoned attorneys with at least 5 years of litigation as well as investigative experience to join the Office in its Investigations Division.

 

Applicants must be able to handle a high volume of work with strict adherence to deadlines in a fast-paced environment.  In addition, applicants for this position should have the ability to think and work independently as well as the ability to work in conjunction with other bureaus in the Office as well as with local, State and Federal law enforcement agencies. 

 

Responsible for long-term investigations, grand jury presentations, trials, and prosecutions in the areas of public corruption, environmental crimes, organized crime, and frauds, including labor fraud, real estate fraud, immigrant fraud, elder fraud, healthcare fraud, consumer fraud, cybercrime and securities fraud.  Responsible for handling a docket of court cases covering the above listed disciplines.

Lateral Assistant District Attorney - Special Victims Bureau


The Special Victims Bureau investigates and prosecutes sexual assault and sexual abuse cases, as well as all incidents of harm to children who are under 13 years of age at the time that the perpetrator is apprehended, including cases of physical abuse, child fatalities, and homicides.
  With regards to sexual assault cases, the bureau, in addition to investigating crimes reported directly to the police, also investigates reports that have been referred to the bureau by the State Central Registry and the Special Commissioner of Investigation for the NYC School District, as well as reports originating from many other sources.  With regards to cases involving child victims, the bureau investigates the thousands of abuse and neglect reports made through the New York State central child abuse registry and it works closely with the Brooklyn Child Advocacy Center.

Lateral Assistant District Attorney - Violent Criminal Enterprises Bureau

The Kings County District Attorney’s Office is seeking attorneys with at least three years of litigation as well as investigative experience to join the Office in our dynamic Violent Criminal Enterprises Bureau.

 

The Violent Criminal Enterprises Bureau (VCE) seeks to stem gun violence and other criminal activity perpetrated by structured criminal organizations including gangs, firearms traffickers, and violent narcotics organizations operating in Brooklyn. The bureau uses multiple investigative strategies, including sophisticated analyses of social media, electronic communications, and other digital evidence, to build successful conspiracy and violence cases against offenders and thereby incapacitate and dismantle these violent enterprises.

 

The primary focus of the bureau is the investigation and prosecution of known drivers of crime who have committed serious offenses, including murder, attempted murder, reckless endangerment, possession and sale of firearms, and other violent offenses, and conspiracy to commit these crimes.  VCE ADAs work closely with the New York City Police Department, federal agencies, and internal detective investigators assigned to investigate this violence. VCE also partners with community groups and religious and business leaders in an effort to deter gang violence. The bureau also investigates and prosecutes high-level narcotics trafficking using investigative techniques such as wiretapping and the use of undercover officers. 

 

VCE uses a team-based approach to its cases.  The bureau’s investigations frequently are staffed with teams of attorneys, analysts, and paralegal staff given their breadth and complexity.  ADAs also are expected to lend assistance as needed on VCE matters, and particularly with long-term conspiracy investigations as they are presented to the grand jury, during takedown, and during discovery compliance.

 

Applicants must be able to handle a high volume of work with strict adherence to deadlines in a fast-paced environment.  Applicants also must be comfortable with drafting complex search warrants, prosecution memoranda, and other legal writing within tight timeframes.  In addition, applicants for this position should have the ability to think and work independently as well as the ability to work in conjunction with other bureaus in the Office as well as with local, State and Federal law enforcement agencies.

  • Proven record of guiding an investigative team in long-term, proactive investigations into complex criminal organizations involved in violent crime.

  • Working knowledge of computer technology and familiarity with electronic review, redaction, and production of discovery in complex cases.

Litigation Compliance Counsel

The Kings County District Attorney’s Office (KCDA) is located in downtown Brooklyn and is one of the largest prosecutors’ offices in the country.  We are committed to developing and implementing innovative prosecutorial strategies to fulfill our commitment to keep Brooklyn safe and ensure fairness and justice for all.

KCDA is seeking candidates to fill newly created positions for Litigation Compliance Counsels within the Homicide Bureau and the Violent Criminal Enterprises Bureau.  Litigation Compliance Counsels will serve as Assistant District Attorneys and will work alongside other ADAs, investigators, and other members of our professional staff on some of our most serious cases to ensure that all criminal discovery materials are collected, protected, and produced in accordance with the law. 

Successful hires may be eligible to transition to litigation positions throughout the Office after serving for two years in the Litigation Compliance Counsel role.

Responsibilities:

  • Assist in all aspects of a complex discovery practice, including the collection, review, organization, redaction, and production of discovery materials.
  • Prepare and argue protective order applications.
  • Help innovate and streamline discovery processes and protocols.
  • Certify discovery compliance in individual cases.
  • Maintain accurate records to prove the defense has received all discovery and that any sensitive information has been redacted in accordance with the law.
  • Assist in responding to motions that challenge discovery compliance.

Qualification Requirements:

  • Admitted to practice law in the State of New York.
  • Minimum three (3) years’ experience as a practicing attorney or similar experience.
  • Ability to serve a minimum of two (2) years in this role.

 Preferred Skills:

  • Knowledge of the rapidly evolving body of case law concerning CPL Article 245.
  • Prior experience with eDiscovery and similar platforms.
